SMS / TEXT MESSAGING POLICY

1. Introduction
This SMS/Text Messaging Policy ("SMS Policy") describes how Entertainment IT, Inc. and its subsidiaries ("Company," "we," "us," or "our") collect, use, and protect information in connection with SMS and text messaging services. This policy applies to all SMS communications sent in connection with any Entertainment IT product or service, including Timer Pro, HyperDeck Backup, Corvo, and future products.
This SMS Policy is part of and incorporated into our Terms of Service and Privacy Policy.
By opting in to receive SMS messages from us, you agree to this SMS Policy. If you do not agree, do not opt in to SMS communications.
2. Consent and Opt-In
2.1 Express Consent Required
By providing your mobile phone number and affirmatively opting in (checking a box, clicking a button, or texting a keyword), you provide express written consent to receive SMS/text messages from Entertainment IT, Inc. at the number provided.
Consent is not a condition of purchasing any product or service.
2.2 How You May Opt In
- Checking the SMS opt-in box during account registration or in account settings
- Texting a designated keyword (e.g., "START" or "JOIN") to our number
- Enabling SMS notifications within any Entertainment IT product
- Providing verbal consent during a support interaction (documented in our records)
2.3 Confirmation
After opting in, you will receive a confirmation message describing the types of messages you will receive, how to opt out, and a link to this SMS Policy.
3. Types of Messages
3.1 Transactional / Informational Messages
We may send the following types of messages:
- Security: Two-factor authentication codes, login notifications, password reset codes, suspicious activity alerts
- Account: License key delivery, subscription confirmations, renewal notices, expiry warnings
- Support: Ticket status updates, support responses
- Service: Maintenance notices, critical service alerts, product updates
3.2 Message Frequency
Message frequency varies based on your account activity and notification settings. You may receive multiple messages in a day during active support interactions, or none during quiet periods. You control frequency through your notification preferences.
4. Marketing Messages
We do NOT send marketing or promotional SMS messages unless you have separately and explicitly opted in to receive marketing communications.
Transactional and informational messages (Section 3) are not marketing messages. If you opt in to marketing messages, you may opt out of marketing separately from transactional messages.
5. We Do Not Share Your Phone Number
WE DO NOT SELL, RENT, LEASE, OR SHARE YOUR MOBILE PHONE NUMBER OR SMS OPT-IN CONSENT WITH ANY THIRD PARTIES FOR THEIR MARKETING PURPOSES.
Your phone number may only be shared with:
- Our SMS service provider (Twilio, Inc.): To deliver messages on our behalf, bound by contractual confidentiality obligations
- Your organization: If you are part of an organization using our products, administrators may access your contact information as part of the service
- Legal requirements: When required by law, subpoena, or court order
6. Opting Out
6.1 How to Opt Out
You may opt out of SMS messages at any time by:
- Texting "STOP" to the number from which you received a message
- Disabling SMS notifications in your account settings within any Entertainment IT product
- Contacting us at support@entertainmentit.co with the subject "SMS Opt-Out"
6.2 Confirmation
After opting out, you will receive a single confirmation message. You will not receive further SMS messages unless you opt in again.
6.3 Transactional Exceptions
Even after opting out of general SMS messages, we may still send critical security messages (such as two-factor authentication codes) if you have enabled two-factor authentication. You may disable this by changing your authentication method.
7. Costs and Carrier Terms
- Message and data rates may apply. Standard messaging rates from your wireless carrier apply to messages sent and received. Contact your carrier for details about your messaging plan.
- We do not charge for SMS messages we send, but your carrier may.
- Carriers are not liable for delayed or undelivered messages.
8. Supported Carriers
SMS messages are supported on most major United States carriers, including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier support is not guaranteed and may change.
9. Data Collection and Privacy
9.1 Information Collected
In connection with SMS messaging, we collect:
- Mobile phone number
- Opt-in/opt-out status and timestamps
- Message delivery status
- Carrier information (as provided by our SMS service provider)
9.2 How We Use SMS Data
SMS data is used solely to:
- Deliver messages you have consented to receive
- Maintain opt-in/opt-out records as required by law
- Troubleshoot delivery issues
- Comply with legal requirements
9.3 Data Retention
- Opt-in/opt-out records: Duration of consent + 5 years (as required by TCPA regulations)
- Message logs: 90 days
- Phone numbers: Until you opt out or request deletion, plus retention period above

10. TCPA Compliance
This SMS Policy and our messaging practices comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable FCC regulations. We maintain records of consent as required by law.
11. Accessibility
If you have difficulty receiving or reading SMS messages, contact us at support@entertainmentit.co for alternative communication options.
12. Changes to This Policy
We may update this SMS Policy from time to time. Material changes will be communicated via SMS or email at least thirty (30) days before taking effect.
